📌 This is the English parallel of अध्यक्षीय एवं उपाध्यक्षीय पदों का निर्वाचन. The two are maintained as separate sets, not as translations of one another. Where rule text is reproduced below it is the original English of the Manual, verbatim.


§1 — 🚨 First things first: this election is INDIRECT

Rule 78(1): "The office of the Chairperson of a Municipality shall be filled by a person chosen by elected members of the Municipality." Explanation: "'Elected member' means a member elected from a ward of the Municipality."

Corroboration: the Commission's Order 1891 dated 18.02.2026 says the same — that elections to municipal chairperson posts are to be held by the indirect method, and that because member seats are filled directly, the postal ballot is to be printed for the member post only.

No EVM is used in the chairperson / vice-chairperson election. It is conducted with ballot papers and a ballot box.


§2 — Eligibility for the office of Chairperson [rule 78(2)–(5)]

Sub-rule Provision
(2) Eligible if he is qualified, and is not disqualified, to be chosen as a member of the Municipality under the Act
(3) 🚨 An elected member is also eligible to be chosen as Chairperson
(4) 🚨 NOT eligible if he is — a Member of Parliament · a Member of the State Legislative Assembly · or a member or chairperson of any Panchayati Raj institution (notwithstanding anything in sub-rules (2) and (3))
(5) Reservation — (a) if the office is reserved for SC/ST/Backward Class, the person must belong to that class · (b) if reserved for women, the person must be a woman · (c) if reserved for a woman of SC/ST/Backward Class, both conditions must be met

🚨 Sub-rule (4) is the single most-missed point at the nomination counter. A sitting MP, MLA, or a member or chairperson of a Panchayati Raj institution is simply not eligible for the chairperson post.


§3 — 🚨 Security deposit — separate from, and far higher than, the member post

Rule 78(6)(i)–(iii) — a nomination paper is not valid unless the receipt of the deposit is attached:

§4 — Chairperson: programme and procedure [rule 78(6)(iv)–(xv)]

Rule 78(6): "The provisions of the rule 10 to 23, 56, 71 to 75, 86, 87 and 88 shall apply mutatis mutandis to the election of a Chairperson, subject to following modifications."

4.1 The programme is counted from the date of the member result

(viii) Symbols are allotted immediately after the expiry of the time fixed for withdrawal
(x) 🚨 The poll, if necessary, shall be held on the third day after the date of withdrawal, at the office of the Municipality, in a meeting of the elected members — or on such other later day as the SEC may fix in extraordinary circumstances. Counting and declaration of result immediately after the close of the poll

4.2 Nomination

(xiv) References to Forms 1, 2, 3, 4, 5, 6, 7, 8, 22A and 23 shall be deemed to include references to Forms 1A, 2A, 3A, 4A, 5A, 6A, 7A, 8A, 22AA and 23A respectively
(xv) The reference to Schedule VI shall be deemed to include a reference to Form 22A-1

Order 1364 dated 04.02.2026 (S.O. 154/2026) prescribes the form of the ballot paper for the chairperson post — this is the discharge of item (ix). (Compendium order serial 63)

4.3 🚨 The meeting notice — what the RO must put on the notice board [item (xi)]

Immediately after the expiry of the time fixed for withdrawal, the RO shall affix on the notice board of the Municipality a notice of the meeting stating —

(a) Time of poll — 10.00 A.M. to 2.00 P.M.(matches the press note)
(b) Counting immediately after the poll is completed
(c) 🚨 "every contesting candidate, whether he is elected member or not, is entitled to attend the meeting to watch the proceedings of poll and counting. However only elected member is entitled to cast his vote in the meeting"

4.4 Extending or closing the poll early [item (xii)]

"the Returning Officer may extend time for poll, if necessary, or may declare the poll as finally concluded earlier in case all the elected member holding office have voted"

4.5 🚨 Oath [item (xiii)]

"a person or elected person after chosen as Chairperson of a Municipality shall hold his office after taking oath before the Collector or his nominee in form prescribed under rule 69"

The rule 69 oath includes the cleanliness pledge"I will devote 100 hours per year, that is two hours per week, to voluntarily work for cleanliness" and "I will encourage 100 other persons to take this pledge". ✅ Commission's Order 4146 dated 21.10.2019 (oath of the elected chairperson and members) — Compendium order serial 65.


§5 — Casual vacancy in the office of Chairperson [rule 78-A]

Sub-rule Provision
(1) A vacancy arising otherwise than by efflux of time shall be filled by a bye-election — 🚨 "in accordance with the provisions of rules as existed at the time of election of the Chairperson who vacated the office". The person so elected holds office for the unexpired term of the predecessor
Proviso 🚨 A person removed from the office of Chairperson under the Act shall not be eligible for re-election to that office for the remaining term of the Municipality
(2) The date of the bye-election shall be fixed by the State Election Commission

§6 — Election of the Vice-Chairperson [Chapter V, rules 79–97]

6.1 When the meeting is held [rule 79]

Sub-rule Provision
(1) The office of Vice-Chairperson shall be filled by a member of the Municipality chosen from among its elected members
(2) 🚨 The meeting of the elected members shall be held at the office of the Municipality at 10 A.M. on the day immediately following the day on which the result of the Chairperson was declared
Proviso The State Election Commission may, for reasons to be recorded, direct that the election of the Vice-Chairperson be held on any other day and time

6.2 🚨 The whole programme in a single day [rule 80]

Immediately on declaring the result of the Chairperson's election, the RO shall affix the notice of the meeting on the notice board, stating —

Time
(a) time for filing nominations 10.00 A.M. to 11.00 A.M.
(b) time for commencement of scrutiny 11.30 A.M.
(c) time before which withdrawal may be made 2.00 P.M.
(d) time of poll (if necessary) 2.30 P.M. to 5.00 P.M.
(e) counting immediately after the poll is completed

Proviso: "the Returning Officer may extend time for poll, if necessary, or may declare the poll as finally concluded earlier in case all the members holding office have voted"

This matches the vice-chairperson table of Press Note 6722 word for word.

6.3 Nomination [rule 81]

Sub-rule Provision
(1) Nomination is by a nomination paper in the form prescribed in Schedule I
(2) 🚨 Every nomination paper shall be signed by a member as proposer, and the candidate shall sign a declaration expressing his willingness to stand
(3) 🚨 A separate nomination paper for each candidate
(4) The nomination paper shall be presented by the candidate or by his proposer on the date, at the place and within the time specified in the notice
(5) As soon as the time for receiving nominations expires, the RO shall publish a list of nominations received in Schedule II

6.4 Scrutiny [rule 82] — only two grounds of rejection

(1) The candidate or his proposer may attend at the appointed time; the RO shall give him all reasonable facilities for examining all nomination papers.

(2) The RO shall decide objections and may reject a nomination only on these two grounds

Ground
(a) the proposer is a person who is not a member of the Municipality
(b) there has been a failure to comply with any of sub-rules (1) to (4) of rule 81

🚨 Proviso: "the nomination of a candidate shall not be rejected merely on the ground of incorrect description of his name or of the name of his proposer or of any other particulars … if the identity of the candidate or proposer … can otherwise be established beyond reasonable doubt"

(3) The RO shall endorse his decision on each nomination paper; where he rejects one, he shall record a brief statement of his reasons in writing.

6.5 List, and withdrawal [rules 83, 84]

  • 83 — the list of validly nominated candidates is drawn up in Schedule III and put on the notice board
  • 84(1) — withdrawal is by a notice in writing in the form of Schedule III-A, before the time fixed under rule 80(c) [2.00 P.M.], and delivered to the Returning Officer personally
  • 84(2) — 🚨 a person who has given a notice of withdrawal cannot cancel it
  • 84(3) — the RO shall arrange the names in the alphabetical order of the Hindi alphabet in Devanagari script, prepare the list of contesting candidates in Schedule III-B, and affix it on the notice board
  • Explanation — 🚨 the alphabetical order goes by the candidates' names, not by their surnames

⚠️ Note the difference from the member post. Withdrawal for the member post (rule 16) has three routes (candidate · proposer · an authorised person if the candidate is in prison or custody). For the vice-chairperson post, rule 84(1) says "deliver the same to the returning officer personally." Do not conflate the two.

6.6 Whether a poll is needed [rule 85]

Sub-rule Situation
(1) 🚨 Only one candidate → no poll; he is declared elected unopposed in the form of Schedule V
(2) Two or more candidates → election by secret ballot, the votes of the members present at the meeting being taken
(3) 🚨 No validly nominated candidate → all the proceedings of the election shall be commenced afresh

6.7 Procedure at the poll [rule 86]

Sub-rule Provision
(1) The RO shall make arrangements to secure the secrecy of the ballot
(2) 🚨 A polling officer shall be appointed by the District Municipal Election Officer to assist the RO
(3) The ballot paper shall be in the form of Schedule IV, duly authenticated by the seal and signature of the RO. Names appear in the same order as in the list of contesting candidates. 🚨 Before issuing a ballot paper the polling officer shall put a tick (✓) against that entry in the list of members
(4) 🚨 The member shall place a mark of cross against the name of the candidate of his choice — with the instrument supplied for the purpose by the RO, and not with any other instrument
(5) He shall fold the ballot paper so as to conceal his vote and insert it in the ballot box kept in the view of the RO
(6) 🚨 If a voter is illiterate, or by reason of blindness or other physical infirmity is unable to make the mark — the Returning Officer, or any other member chosen by the voter, shall record the vote according to his wish and fold it; the voter himself, or with the RO's assistance, shall insert it in the box
(7) The ballot box shall be so constructed that ballot papers can be introduced therein but cannot be withdrawn
(8) Every person shall record his vote in person

🔴 Printing defect (recorded, not altered): on printed page 115 of the Manual, sub-rule (8) appears as "Every person wishing to record his vote shall do in person can be introduced therein but cannot be withdrawn." — i.e. the tail of sub-rule (7) has been repeated into (8). The intended text is plainly "…shall do so in person." This is a printing error in the Manual, not in the law.

6.8 Counting and result [rule 87]

(1) The RO shall scrutinise the ballot papers and separate the valid from the invalid, endorsing on each invalid paper the word "rejected" and the ground of rejection.

(2) Four grounds of invalidity —

(i) it bears any mark or signature by which the voter can be identified
(ii) the mark is placed against more than one name
(iii) it bears no mark, or the mark is so placed that it is not possible to ascertain for whom the vote has been given, or the mark is made by an instrument other than the one supplied by the RO
(iv) the ballot paper is spurious

(3) A ballot paper not rejected shall be counted as one valid vote (4) 🚨 In the case of an equality of votes — the RO shall forthwith decide by lot between those candidates, and proceed as if the candidate on whom the lot falls had received an additional vote (5) The candidate securing the highest number of votes shall be declared elected (6) The result of the election of the Vice-Chairperson shall be declared in the form of Schedule VI


6.9 Record of proceedings and publication of the result [rule 88]

Immediately after the declaration of the result, the Returning Officer shall —

(a) prepare a record of the proceedings in the form of Schedule VIII
(b) publish a notification under his signature on the notice board of the Municipality stating the name of the Vice-Chairperson elected, and send a copy of it to —

The copy goes to four places:

6.10 Packing and custody of records [rule 89]

Sub-rule Provision
(1) The RO shall make packets of the ballot papers and other papers relating to the election, seal them, and mark on them a description of the contents and the election to which they relate
(2) 🚨 The packets shall be kept in the safe custody of the District Municipal Election Officer for six months, and shall thereafter be destroyed — unless a competent court directs otherwise
(3) 🚨 While in the custody of the DMEO the packets shall not be opened, nor their contents inspected, nor shall they be produced before any person or authority — except on the order of a competent court

6.11 🚨 Rules 90 to 94 — DELETED

All five deleted by notification No. F.8(ga)( ) Rules/DLB/19/23179 dated 31.01.19, published in the Rajasthan Gazette Extraordinary Part 6(A) dated 01-02-2019.

What this means — and it simplifies the training considerably: There used to be five separate rules for Vice-Chairman / President / Vice-President / Mayor / Deputy Mayor. They have all been removed, and the generic Chapter V rules 79–89 on the "Vice-Chairperson" now govern all three types of bodies. One procedure for all three, whatever the office is called.

6.12 Casual vacancy in the office of Vice-Chairperson [rule 95]

Sub-rule Provision
(1) A vacancy arising otherwise than by efflux of time → bye-election, "in accordance with the provisions of rules as existed at the time of election of the Vice-Chairperson who vacated the office"; the term is the unexpired term of the predecessor
Proviso 🚨 A person removed from the office of Vice-Chairperson under the Act is not eligible for re-election for the remaining term of the Municipality
(2) 🚨 The date of the bye-election — and also the period of notice to be given to the members — shall be fixed by the State Election Commission
(3) The result shall be declared in the form of Schedule VII

6.13 🚨 First meeting [rule 96]

"The meeting held for the election of the Chairperson of a municipality shall be the first meeting of the municipality."

That is, the meeting at which the Chairperson is elected is itself the first meeting of the Municipality — no separate "first meeting" is convened.

6.14 Removal of difficulties [rule 97]

"If any difficulty arises in the implementation of these rules, the State Election Commission or any authority directed by it, may by an order in writing give directions as may appear necessary to it for the removal of any such difficulty."

(This is the power under which the Commission issued the indelible-ink order 2205 dated 04.07.2019 and the preventive-detention order 1418 dated 05.02.2026.)

⚠️ Schedule I says "the Act, 1959" — do NOT "correct" it

The candidate's declaration reads "…I do not hold any of the disqualifications enumerated in the Rajasthan Municipalities Act, 1959…"

The Act in force is the Rajasthan Municipalities Act, 2009 (Act 18 of 2009).

🚨 But this is not a stray slip in one form — it is how the 1994 Rules are built. They were framed under the 1959 Act, so 1959 references survive throughout (for example rule 13(5) likewise refers to "section 18 of the Rajasthan Municipalities Act, 1959 (38 of 1959)").

➡ Have the form filled in exactly as printed. Do not alter it as "wrong". If a candidate asks, explain that the disqualifications today come from section 24 of the 2009 Act, and the older reference survives by operation of repeal and savings.


Schedule III-A (withdrawal) — "personally" is printed into the form

The RO's endorsement reads:

"This notice was delivered to me in my office at …(hour) on …(date) by Shri … the candidate personally."

This confirms rule 84(1) as recorded at §6.5 — for the vice-chairperson post there is no proposer route for withdrawal. The form itself bears this out.


Schedule VII — the five causes of a casual vacancy are printed in the form

"…to fill the vacancy of Vice-Chairman caused by the resignation / death / removal / passing of no-confidence motion against / election has been rendered void of Shri …"

🔎 A small printing inconsistency (recorded, not altered)

Schedule VI is headed "Vice-Chairperson", but the operative sentence of the same form reads "…duly elected to fill the office of Vice-Chairman…". A printing inconsistency, not a defect in the law — use the form exactly as printed.


§7-B — 🚨 Order 1607 dated 11.02.2026 — directions for the vice-chairperson election (read 22.08.2026)

🚨 This order supersedes the earlier letter 3564 dated 23.09.2019 and takes effect immediately.

1. 🚨 The most practical point — no election symbol goes in the "Vote Mark" column

"In the ballot paper form, the election symbol shall NOT be entered in the 'Vote Mark' column; rather the mark by which the voting members record their vote — that is, the cross mark — shall be placed there."

🚨 This is easy to get wrong. Reading "Vote Mark", an RO may assume the election symbol belongs there. That column is for the voter, not for the candidate. (It matches rule 86(4) at §6.7 — the member places a mark of cross with the instrument supplied by the RO.)

2. The ballot paper form was never prescribed in the Rules — the Commission supplied it

Rule 86(3) says the ballot paper shall be in the form of Schedule 4"but no form has in fact been prescribed for this in the rules." To remove that practical difficulty

3. 🚨 Two more forms the Rules never prescribed — the Commission made model forms

"For the election to vice-chairperson posts the Returning Officer will need a list of the members elected from the wards and a notice for the meeting of the elected members. … No form is prescribed in the rules. The Commission has therefore prepared model forms."

4. ✅ The puzzle of the schedules is solved — the 2019 amendment

Order (67) records that rule 14 of the Rajasthan Municipalities (Election) (Amendment) Rules, 2019, issued under Autonomous Government Department notification No. 23179 dated 31.01.2019

This is exactly what I saw on the pages at §7-A — Schedules I to VII naming only the Vice-Chairperson, and Schedule VIII naming all six offices. Now the source is known too. (It is the same notification 23179 of 31.01.2019 that deleted rules 90–94 — see §6.11.)

🚨 And it supplies context: that notification was issued "for chairperson posts to be elected by the DIRECT method". The position today is different — under order 1891 dated 18.02.2026 the chairperson election is INDIRECT (see §1). The later document prevails.

§7-C — 🚨 Order 5164 dated 15.11.2019 — directions for the chairperson election (read 22.08.2026)

Item 5: "Where the office of Chairperson is reserved for a caste or class … only a candidate of that caste and class shall be eligible … For this purpose the candidate must attach, with the nomination paper, a copy of the caste certificate issued by the competent authority of the State Government."

Add this documentary requirement alongside the reservation condition at §2 — it was not in this module before. (The same requirement for the member post is at rule 12(8).)

🚨 This is where the wrong ballot gets printed. The chairperson's ballot needs symbols; the vice-chairperson's must not have them. (It is logical too — any eligible person may contest the chairperson post, whereas only elected members, known to everyone, contest the vice-chairperson post.)

Vice-chairperson ballot — the specification in order 1357 (5 points)

Why it was issued: rule 86(3) says the ballot shall follow Schedule IV, "but nothing is made clear about the size of the ballot paper or the space for the candidates' panels" — so the order issues under rule 97.

§7-E — 🚨 Orders 1381 (meeting notice) and 1374 (result documents) (read 22.08.2026)

1. Order 1381 dated 04.02.2026 — notice of the chairperson election meeting

It confirms §4.3 word for word — the order reproduces rule 78(6)(xi) verbatim: (a) 10.00 AM to 02.00 PM as the hours of Poll · (b) counting immediately after completion of poll · (c) every contesting candidate … entitled to attend … However only elected member is entitled to cast his vote in the meeting.**

🚨 New — the Commission has its own form for the meeting notice

"So that there is uniformity in the form of the notice for the meeting of elected members for the chairperson election … the Commission has prepared a form and is sending it enclosed with this letter."

⚠️ Do not draft your own. The two posts have different forms — Chairperson: the form enclosed with order 1381 · Vice-chairperson: Appendices 2 and 3 of order 1607 (members' list and meeting notice) — see §7-B


2. 🚨 Order 1374 dated 04.02.2026 (S.O. 155/2026) — within three days of the result

Under rule 68 read with rule 72 — so that the names of elected members can be published in the Gazette, the RO shall send the following to the Commission 🚨 within three days of the declaration of results:

⚠️ This is for the chairperson post. The electorate is only the elected members, so the count is the number of wards plus a small margin. Do not confuse it with member-post ballots or EVMs.

🔎 A citation discrepancy (recorded, not altered): the order cites "rule 83(3)" for authentication, but the authentication provision is rule 86(3) (see §6.7). The substance is right, the number is doubtful. Cite rule 86(3) in training.


2. 🚨 Order 4146 dated 21.10.2019 — the oath comes BEFORE the chairperson election

Compendium order (65), printed p. 271 — I read the page image myself. Supersedes the earlier letter 3438 dt 17.09.2019 — signed Shyam Singh Rajpurohit, Secretary.

Basis: s.37 of the Act 2009 read with rule 69 — every elected chairperson and member of a municipality shall, before entering upon his duties, take or subscribe an oath or affirmation before the Collector or his nominee and sign it. (State Government notification dated 05.08.2019 amended the form of oath in rule 69.)

🚨 Effect on the calendar: the member result is 14.09.2026, the chairperson election 21.09.2026. All elected members must have been sworn in during those intervening days — otherwise the electorate at the 21.09 meeting is itself incomplete.

What the Commission expects — the Collector nominates the RO/ARO

"The Commission expects the District Collectors to nominate the municipality's Returning Officer / Assistant Returning Officer under rule 69 to administer the oath or affirmation to the Chairperson and the members."

In practice the RO/ARO administers the oath — as the Collector's nominee. The RO should get that nomination in writing in advance.

This also confirms §4.5"before the Collector or his nominee, in the form under rule 69". What is new is that the members' oath is a precondition to the chairperson election.


§7-G — ✅ The enclosures to order 1607 have now been read — specimen ballot and meeting notice (22.08.2026)

§7-B recorded that order (67)'s enclosures were "not opened". They have now been openedAppendix-1 (printed p. 286) and Appendix-3 (printed p. 288).

🔎 A small detail visible only in the specimen: the NOTA row carries no serial number — it follows the last candidate unnumbered.

2. The meeting-notice model form (Appendix-3) — seven items

All seven match §6.2 (rule 80) exactly — meeting at 10.00 AM, nominations 10.00–11.00, scrutiny 11.30, withdrawal before 2.00, poll 2.30–5.00, counting immediately after.

Two things that were not in this module —

"For the election of the Vice-Chairperson under section 43 of the Rajasthan Municipalities Act, 2009 and rule 79 of the Rajasthan Municipalities (Election) Rules, 1994, I … hereby give notice in accordance with rule 80"

➡ My §6 cited only rules 79/80. The statutory hook is section 43 — put both in the notice.

Finding (an absence, which is still a finding): No provision in any compiled law available to us reserves the vice-chairperson post. The field in the model form appears to be without a traceable source.

Two possibilities

🚨 How to settle it — three routes, in this order

3 A written reference to the Commission, if 1 and 2 do not settle it the form is the Commission's own, so the clarification should come from it

What to do meanwhile

If the DEO or the notification says the post IS reserved → state the category in the notice. ✅ If no reservation is shown → write "not applicable" in the field — do not leave it blank. 🚨 Do not assume a reservation yourself. The chairperson reservation [s.43(3), rule 78(5)] does not carry over to the vice-chairperson post — they are different offices.

✅ The notice also corroborates two things

  • Item 2: the nomination may be delivered by the candidate or his proposer — ✅ §6.3 [rule 81(4)]
  • Item 5: withdrawal is given by the candidate personally — ✅ §6.5 [rule 84(1)] and Schedule III-A
