§1 — 🚨🚨 Documents for identifying a voter — Annexure-16 has been superseded

⛔ Stop — Annexure-16 of the Margdarsika is no longer in force

Annexure-16 of the Margdarsika = order 603 dated 19.01.2026. The State Election Commission has itself superseded it —

✅ The order in force: F.1(2)(1)Npa-Pancha/S.O./RaNiA/14/5310 dated 30.07.2026

The original text of order 5310:

"… superseding its earlier order no. 559 dated 07.02.2019 and order no. 603 dated 19.01.2026, directs that, for the purpose of polling at an election in any municipality or Panchayati Raj institution of the State, a voter shall have to produce, for establishing his identity, the Elector Photo Identity Card issued by the Election Commission of India. If an elector is unable to produce his Elector Photo Identity Card, then, for establishing his identity, he shall have to produce any one original document out of the following alternative photo documents issued prior to the announcement of the election:—"

🚨 Three new requirements compared with order 603 (Annexure-16)

The name of item 2 has also changed: Annexure-16 had only "MGNREGA card"; order 5310 has "Viksit Bharat – Guarantee for Employment and Livelihood Mission (Rural) (VB-G RAM G) / MGNREGA card".

The remaining 10 items are unchanged, and the head-of-the-family provision also stands as before.

1.0 ✅ The list in force — order 5310 dated 30.07.2026

Primary document = the Elector Photo Identity Card (EPIC) issued by the Election Commission of India.

If he is unable to produce it — any ONE original document out of the following 11:

1.0-A 🚨 Action on impersonation — the new part of order 5310

"For the conduct of a clean and transparent election it is necessary that bogus / false voting be prevented. … If any voter attempts to vote on the basis of a false or forged identity card, or to vote by impersonating another voter, action shall be taken against him under section 172 of the Bharatiya Nyaya Sanhita."**

The order quotes the text of both section 172 (impersonation at an election) and section 174 (punishment — imprisonment up to one year, or fine, or both), and also the proxy-voting exception:

"Provided that nothing in this section shall apply to a person who has been authorised to vote as a proxy for an elector under any law for the time being in force…"

✅ This also cures an error in Annexure-9 of the Margdarsika — that form cites section 171-F of the repealed IPC 1860; the Commission's own latest order says sections 172 / 174 of the Bharatiya Nyaya Sanhita. In the complaint to the SHO, write BNS sections 172 / 174.

1.1 (Superseded) Annexure-16 — order 603 dated 19.01.2026

1.1-A The basic rule

🚨 Primary document = the Elector Photo Identity Card (EPIC) issued by the Election Commission of India.

"The electoral roll of the State Election Commission is prepared by dividing the database of the Assembly electoral roll ward-wise, so that voters registered in the Assembly electoral roll become automatically registered as voters in the electoral roll of the State Election Commission. Hence … they have with them the photo voter identity card issued by the Election Commission of India, which is the primary valid document for the identification of a voter at the time of polling."

1.2 The alternative photo documents — only these 11 🚨

"If an elector is unable to produce his Elector Photo Identity Card, he shall have to produce … any one of the following alternative photo documents:—"

🚨 This list is exhaustive. No document other than these is acceptable.

1.3 Identification by the head of the family 🚨

"On the basis of the Elector Photo Identity Card, or the alternative identity documents shown above, issued to the head of the family, only the head of the family shall be permitted to identify his other family members, provided that all the members come along with him and their identity can be established by the head of the family."**

1.4 The power to put questions — rule 40 🚨

The preamble of the order quotes rule 40 of the Raj. Municipalities (Election) Rules 1994:

"At any time before a ballot paper is delivered to a voter, the presiding officer or a polling officer may, of his own motion if he has reason to doubt the identity of the voter or his right to vote at that polling station, and shall, if so required by any candidate or polling agent, put to the voter such questions as he thinks necessary for satisfying himself that such person is the voter to whom that entry relates."

(The same appears at [MG Ch.3(8)16] without the rule number — now confirmed as rule 40.)

🔴 A fine point — at an EVM poll it is rule 40-A, not rule 40 (23.08.2026)

The order's preamble quotes rule 40 — the extract above is faithful. But under rule 77-A, where a voting machine is used rule 40 is displaced and 40-A applies.

The original text of rule 40-A (read first-hand):

"40-A. Identity of voter.— At any time before permitting the voter to vote the presiding officer or polling officer may of his own accord, if he has reason to doubt the identity of the voter or his right to vote at such polling station and SHALL, if so required by a candidate or polling agent, satisfy himself by putting to the voter such questions as he may deem necessary that such person is identical with the voter to whom such entry relates."

✅ The substance is the same; the only difference is that 40 says "before a ballot paper is delivered" while 40-A says "before permitting the voter to vote". 🚨 Both carry the same two-tier structure — "may" of his own accord, but "SHALL" if a candidate or polling agent requires it. That limb is a duty, not a discretion. Cite 40-A in training.

1.5 The link to the diary 🚨

Item 18 of Annexure-7 requires a count — (a) those identified by the photo voter identity card; (b) those identified by the alternative documents. That count must therefore be kept separately all day.

§2 — 🚨 Annexure-18 — on which finger the indelible ink goes

Order no. F.1(4)(1)/Nagarpalika/RaNiA/2014/2205, Jaipur, dated 04.07.19 · Power: rule 97 (removal of difficulties)

2.1 The original (English) text of rule 35-A(2)

(2)(a) Before permitting a voter to vote, the presiding officer shall cause a mark to be put on the left forefinger of the voter with an indelible ink; Provided that where such a mark already exists on the left forefinger of the voter, it shall be deemed that he had cast his vote already at the election and shall not be permitted to vote. Provided further that no voter shall be allowed to vote unless he has allowed a mark to be put on his left forefinger with an indelible ink.

(b) Any reference in this sub-rule to the left forefinger of a voter shall in the case where the voter has his left forefinger missing, be construed as a reference to any other finger on his left hand and shall in the case where all the fingers of his left hand are missing, be construed as a reference to the forefinger of the right hand and shall, in case the fingers of both the hands are missing, be constructed as a reference to such extremity of the left or right arm as he possesses.

(The misprints — "indelible inka;s", "constructed" — are in the original text itself; quoted verbatim.)

🚨 The legal point: under the first proviso, if a mark already exists on the left forefinger, it shall be deemed that he has already voted and he shall not be permitted to vote.

2.2 Three situations — which finger

ℹ️ "If municipal elections are held immediately after a re-poll at a Lok Sabha or Vidhan Sabha election, separate instructions will be issued for the application of indelible ink in such a case."

⚠️ Which situation applies at this election must be confirmed from the district's / the Commission's order.~~ ~~Annexure-17 (the Election Commission of India's indelible-ink order) has not yet been read.~~ 🔴 Corrected 23.08.2026 — Annexure-17 HAS been read, and it is not the ECI's — it is the State Commission's own order 1408 dt 04.02.2026. There is no conflict with Annex-18 → §2-A below.

§2-A — 🔴 Annexure-17 has been read — and it is NOT the Election Commission of India's (23.08.2026)

✏️ Correction — the map above and §2.2 described Annexure-17 as "the Election Commission of India's order on indelible ink". That was wrong. I read both pages myself — it is the State Election Commission, Rajasthan's** own order.

🔴 Four directions

🔴🔴 Direction 3 places a duty directly on the DLMT — two things: (1) bring this instruction to the notice of every PRO and PO during the training; (2) 🚨 have a copy placed in the Presiding Officer's kit — that is a material-check item. (The same pattern appears in order 4297 (PwD) — see BALOTRA §6-क.)

✅ Annex-17 and Annex-18 do not conflict — they answer different questions

§2.2 above said "Annexure-17 has not yet been read" and §11 said "may differ from Annex-18 — a comparison is necessary". The comparison has been done — there is no conflict.

✅ Read them together: Annex-18 tells you which finger; Annex-17 tells you how to mark that finger.

✅ Direction 2 corroborates our material — 09 §5(3) already says the Third Polling Officer checks the left forefinger. Now it has an order behind it too — order 1408, direction 2.

§2-B — 🔴 Annexures 10 and 11 — the declaration as to age (read first-hand 23.08.2026)

Annexure-10 — the elector's declaration as to age [see Part-6, para 3]

The declaration's original text:

"I solemnly declare and affirm that on the 1st of January 20…. — that is, on the qualifying date by reference to which the electoral roll of this constituency was prepared / revised — my age was more than 18 years."

🚨 It is not a declaration of today's age — it is of the age on the qualifying date (1 January).

✏️ 🔴 A reference to a repealed Act — exactly as in Annexure-9

The declaration's second paragraph reads —

"… I am aware of the penal provisions of section 15 of the Rajasthan Municipalities Act, 1959 regarding a false declaration …"

🔴 The Act in force today is the Rajasthan Municipalities Act, 2009. ✅ Conveniently the section number is unchanged — section 15 of the Act 2009 ("Making a false declaration") covers precisely this offence (a false statement in connection with the preparation, revision or correction of a roll, or the inclusion or exclusion of an entry) — imprisonment up to one year, or fine, or both → §10.1.

🚨 Say this in training: "the form prints 1959; read 2009. The section is the same — 15." ✅ This is the twin of Annexure-9's IPC 171-F problem — the pro-formas keep carrying the name of the old law. Neither changes what you do — only which Act you cite.

🔴 The Presiding Officer's certification block

"It is certified that the elector named above made the above solemn declaration in my presence and signed it." — Signature of the Presiding Officer

✅ This is the third form the officer must counter-sign — Form 9 (polling agent) · Form 19 (counting agent) · Annexure-10 (age). ❌ Not Annexure-12 (the companion) — that one carries the companion's signature only.

Annexure-11 — the list, in two parts

Both parts have five columns:

Date · Signature of the Presiding Officer

🚨 Column 5 was not in the module. The Presiding Officer must record his own determination of the age alongside the roll's entry. That is a written decision.

✅ The two parts map exactly onto diary item 17 — "(a) those from whom declarations as to age were obtained; (b) those who refused to make such a declaration." Both counts come from here.

Both → envelope E-14 (not sealed).

§3 — 🚨 The postal ballot — two envelopes [Forms 16-A, 16-B, 16-C, 16-D]

Legal basis: rule 46-A(4) and rule 78. (In the heading of Form 16-D the sub-clause letter is printed corruptly in the original — "46A(4)(?k)". Recorded as found.)

3.1 The four forms

All three forms carry the alternative "from ward no. ...... / *for the office/seat of Chairperson" — that is, this same set is used at the election of the Chairperson as well.

3.2 What the voter must do — the substance of Form 16-D 🚨

1. Recording the vote: put a clear mark on the ballot paper against the name of the candidate or against NOTA (none of the above). "The mark should be so placed that it clearly and beyond any doubt indicates the candidate to whom you are giving your vote. If the mark is so placed as to raise a doubt … your vote will become invalid."
2. 🚨 "The number of members to be elected is one … you have only one vote … you must not vote for more than one candidate. If you do so, your ballot paper will be rejected."
3. 🚨 "Do not sign your name on the ballot paper, or write any word, or put any mark, sign or writing whatsoever, other than the required mark."
4. Place the ballot paper in the small envelope marked "A", close it, and secure it with a seal or otherwise.
5. Sign the declaration in Form 16-A in the presence of a gazetted officer, or of the presiding officer of the polling station at which you are on election duty, and get it attested by him. 🚨 "You must neither show your postal ballot paper to the attesting officer nor tell him how you have voted."
6. The declaration (16-A) + envelope "A" → put both into the large envelope marked "B"; close the large envelope and send it to the Returning Officer by post, by messenger, or in person. 🚨 The voter must put his full signature in the space provided on the envelope marked "B".
7. Time limit: the envelope must reach the RO before the date and time fixed for the commencement of the counting.

3.3 Two reasons why a postal ballot will not be counted 🚨

i. "If you fail to get your declaration attested in the manner shown above, your ballot paper will be rejected", and ii. "If the envelope reaches the Returning Officer after … o'clock, your vote will not be counted." (the date and time fixed for the commencement of the counting is specified here)

✅ This is the rule-level answer to [STATUS §4, question 4 — "the postal-ballot envelopes: one or two?"]: the postal ballot returned by the voter always goes in two envelopes — the small "A" (the ballot paper only) inside the large "B" (declaration 16-A + envelope "A"). ⚠️ The original question was about the number of packets at the RO's receiving end ([SO 157 ¶11] vs [2292 ¶11(5)]) — that still has to be re-checked in the light of this conclusion. Recorded in GAPS.

§4 — Annexure-6 — the Presiding Officer's three declarations

Heading: name of the municipality · ward no. · serial number and name of the polling station · date of poll (for use only at polling stations where a voting machine is being used)

Part 1 — before the poll commences

I declare that:— 1. I have demonstrated to the polling agents and the other persons present, by holding a mock poll, that— (a) the voting machine(s) is / are working properly and no vote is recorded inside it; (b) the marked copy of the electoral roll bears no mark other than those used for the issue of postal ballot papers and election duty certificates; (c) no entry has been made in the register of voters (Form 14-A) in respect of any elector. 2. I have put my own signature on the paper seal to be used for securing the result section of the Control Unit, and have obtained the signatures of those polling agents who were present and were willing to sign.

Boxes: signatures of polling agents 1–7 · "the following polling agent(s) refused to sign this declaration" 1–3 · date · signature of the Presiding Officer

Part 2 — at the time of using a subsequent (new) voting machine 🚨

1. I have demonstrated … by a mock poll that the next voting machine to be used for the poll is empty and is working properly. 2. My own signature on the paper seal + the signatures of the willing agents.

The same boxes: signatures 1–7, refusals 1–3, date.

Part 3 — at the close of the poll, after the machine has been sealed

"I have affixed my seal and have permitted those polling agents who were present at the close of the poll to affix their seals on the boxes of the Control Unit and the Balloting Unit of the voting machine."

§5 — Annexure-7 — the Presiding Officer's Diary (30 items)

5.1 The complete list

At the foot: place · date · name and signature of the Presiding Officer

5.2 The two mandatory notes on the diary

1. "If there is not enough space against any item in this form, the information should be written on a plain sheet and attached to this diary." 2. "Send the Presiding Officer's Diary to the Returning Officer along with the voting machine and the other sealed papers." (envelope E-11, not sealed, counter no. 1)

🚨 And [MG Ch.14(4)10]: "Complete the entries whenever an incident occurs, not at the close of the poll."

§6 — Annexure-8 — the filled specimen of Form 14-C

§8 — Annexure-15A — particulars of the envelopes

Its title: "Particulars of the envelopes which the polling party is to prepare booth-wise" — that is, these envelopes are prepared booth-wise in advance and given to the polling party.

✅ This is an independent confirmation of the envelope map at 07 §9. The packet rule [MG Ch.13]: "All the above envelopes (E-1 to E-8) shall be sealed, of which envelopes E-1 to E-6 shall form a separate packet."

§9 — Annexure-20 = S.O. 145/2026 — sealing the machine

Legal basis — rule 47-A(2): "After the close of the poll the presiding officer shall seal the Control Unit and the Balloting Unit of the EVM used for the offices of members in such manner, and secure them separately, as the State Election Commission may direct, and … the seal shall be affixed in such a way that it will not be possible to open the units without breaking the seals."

The seven directions

⚠️ The candle warning [MG Ch.4 / 4-A]: "While sealing … the open flame of the candle must not come into contact with the carrying cases. Molten wax must not fall on any part of the machine."

§10 — Annexure-1 — extracts from the Bharatiya Nyaya Sanhita 2023

172 — Personation at elections:

"Whoever at an election applies for a voting paper or votes in the name of any other person, whether living or dead, or in a fictitious name, or who having voted once at such election applies at the same election for a voting paper in his own name, and whoever abets, procures or attempts to procure the voting by any person in any such way, commits the offence of personation at an election."

174 — Punishment for undue influence or personation at an election:

"Whoever commits the offence of undue influence or personation at an election shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both."

✅ This confirms the quotation of the warning given at 07 §2 — challenged votes.

§11 — ✅ NOTHING REMAINS UNREAD (closed 23.08.2026)

This section used to list the annexures and forms that had not been read, with the standing caution that nothing had been asserted from them. That list is now empty.

Every annexure and every form in the Margdarsika's annexure part (printed pp. 68–133) has been read first-hand, together with the whole of Chapter III-A of the Rules and every statutory form printed in the ULB Manual. The map at the top of this file records what each one yielded.

🔴 What reading the last of them produced

⚠️ One caution stands. Being read is not the same as being free of defects. Three of these pro-formas cite repealed law — Annexures 9 and 10, and Form 14-C's item 3 label (rule 45-A, deleted). In each case the instruction is sound and only the citation is stale — see the item concerned.
